Federal Judge Mandates Release of Abrego Garcia from ICE Custody

A federal judge has ruled the prompt discharge of Kilmar Abrego Garcia from detention by ICE, concluding his continued confinement is without legal authority.

"Since Abrego Garcia's return from erroneous detention in El Salvador, he has been re-detained, again without lawful authority," the judge stated in her order.

The situation stems from a mistaken deportation to El Salvador earlier this year, which US authorities later admitted was an error. After his return to the United States to answer alien smuggling allegations, he was detained in federal custody.

In her decision, the court pointed out that the government lacks a valid deportation order, which prevents them from removing Mr. Abrego Garcia "for now."

Context of the Legal Challenge

The legal challenge center on conflicting assertions. While the former administration argues that Abrego Garcia is a member of the MS-13 gang, he vehemently disputes this allegation.

He has also entered a not guilty plea to the conspiracy counts, which are part of a separate trial in Tennessee.

Conditions of Release

The judge, who was overseeing his petition to deportation in a federal court, ruled that he must now adhere to the conditions of his bond from jail in Tennessee. This decision effectively transfers his supervision to the jurisdiction handling his criminal case.
